Abstract

Cybercrime is a traditional form of threat to national security that requires further attention, one of which is online gambling cybercrime. Since 2015, this crime has experienced a rapid escalation in impact, referring to the development of accumulated transaction data. Criminal policy needs to be formulated and implemented properly to deal with this crime. This research uses a normative legal research type by positioning law as a set of norms that regulate state policy in dealing with cybercrime, especially online gambling, as part of the national security threat. This study aims to analyze the potential threat to national security from online gambling and the appropriate form of criminal policy to deal with it. The results of this study are: (1) online gambling threatens cybersecurity and national security simultaneously through the distribution of negative content and the potential for personal data theft. Furthermore, online gambling threatens the socio-economic conditions of society due to its addictive impact. (2) criminal policy must be more coherently integrated through both penal and non-penal approaches to ensure more effective mitigation from potential risks to actual impacts.
